Job Description: HR Executive – US Staffing & Compliance
Position Overview
We are seeking a detail-oriented and knowledgeable HR Executive – US Staffing & Compliance to manage end-to-end compliance operations for our US staffing/recruitment business. The ideal candidate will ensure full adherence to federal, state, and client-specific employment regulations while supporting the onboarding, documentation, and lifecycle management of contract, contract-to-hire, and full-time placements across the United States.
Location: Remote (India) – Supporting US Staffing Operations
Shift: Night Shift – US Business Hours (8:30 PM – 5:00 AM IST / PST as applicable)
Experience Required: 2–6 years (adjust based on level)

Eligibility: Candidates based in India with prior experience in US IT/Non-IT Staffing HR, Compliance, or Bench Sales support processes
Key Responsibilities1. Employment Compliance
- Ensure compliance with I-9 verification, E-Verify, and Form W-4/W-9 processes for all new hires and consultants.
- Monitor and enforce compliance with FLSA, EEOC, ADA, FMLA, and state-specific labor laws across multiple states.
- Track and manage visa documentation (H-1B, OPT/CPT, GC, TN, L1, etc.) in coordination with immigration/legal counsel.
- Maintain up-to-date knowledge of state-wise staffing regulations, paid sick leave laws, and right-to-work requirements.
- Ensure background check, drug screening, and reference check processes align with FCRA and state "ban-the-box" laws.
2. Contracts & Documentation
- Draft, review, and manage MSAs (Master Service Agreements), SOWs, and Employment Agreements with clients and vendors.
- Ensure all Non-Compete, Non-Disclosure, and Right-to-Represent documents are executed correctly.
- Maintain audit-ready personnel files (physical/digital) in compliance with document retention laws.
- Liaise with VMS/MSP portals (Fieldglass, Beeline, IQNavigator, etc.) for compliance submissions and reporting.
3. Payroll & Benefits Compliance
- Coordinate with payroll/finance teams to ensure accurate W-2/1099 classification and timely tax filings.
- Ensure compliance with ACA (Affordable Care Act) reporting requirements for benefits-eligible consultants.
- Oversee unemployment insurance claims, workers' compensation, and state disability filings.
- Support multi-state payroll tax registration as new consultants are placed in new states.
4. Onboarding & Employee Lifecycle
- Manage end-to-end onboarding for W-2 employees, 1099 contractors, and C2C consultants.
- Ensure timely completion of background verification, drug testing, and client-specific compliance requirements.
- Handle offboarding, exit formalities, and compliance documentation closure.
5. Audit & Reporting
- Conduct periodic internal compliance audits to identify and mitigate risk.
- Prepare and maintain EEO-1, VETS-4212, and other federal compliance reports.
- Support external audits from clients, state agencies, or certifying bodies (e.g., MBE/WBE/WOSB certifications).
- Maintain compliance trackers/dashboards for leadership visibility.
6. Stakeholder Management
- Act as the primary point of contact for client compliance teams, vendors, and legal counsel.
- Train internal recruiters and account managers on compliance protocols and documentation standards.
- Stay updated on changing labor laws and proactively update internal policies.
Required Skills & Qualifications
- Bachelor's degree in Human Resources, Business Administration, or related field (Master's/MBA preferred).
- 2–6 years of experience in US Staffing HR/Compliance, preferably with an IT/Non-IT staffing firm.
- Strong knowledge of I-9, E-Verify, FLSA, EEOC, ACA, FCRA, and multi-state employment law.
- Hands-on experience with VMS tools (Fieldglass, Beeline, IQN) and ATS/HRIS systems (Bullhorn, Ceipal, JobDiva, ADP, etc.).
- Familiarity with visa types (H-1B, OPT, GC, TN, etc.) and immigration documentation basics.
- Excellent communication, negotiation, and stakeholder management skills.
- High attention to detail with strong organizational and multitasking abilities.
- Ability to work in US shift hours and manage time-zone-sensitive coordination.
Preferred Certifications (Nice to Have)
- PHR / SHRM-CP / SHRM-SCP
- Certification in US Employment Law or HR Compliance
