Job Summary:
We are seeking an experienced Senior Advocate to handle Real Estate and Construction cases, specifically managing both local court matters in Pune and appearances before the High Court in Mumbai. The Senior Advocate will be responsible for providing comprehensive legal services, including case preparation, representation, and legal advisory, while effectively managing multiple matters at both the local and High Court levels. This role requires significant experience in the Real Estate and Construction sectors, a high level of legal expertise, and the ability to seamlessly coordinate between local courts and the Bombay High Court.
Key Responsibilities:
1. Case Management and Representation:
Local Court Case Handling (Pune):
- Represent clients in Pune District Court, Sessions Court, and Civil Courts in real estate, construction, and contractual disputes.
- Ensure timely filing of documents, including affidavits, plaints, applications, and evidence.
- Draft and file petitions, written statements, and appeals for property disputes, construction delays, contractual obligations, and title-related issues.
- Appear in routine hearings and manage legal processes for property disputes, land acquisition matters, contractual violations, and other real estate-related matters.
- Handle Civil, Criminal, Consumer, Arbitration, Land Revenue matters, Maharashtra RERA matters, and proceedings before Municipal Corporations and other relevant authorities.
High Court Case Handling (Mumbai):
- Represent clients before the Bombay High Court in appeals, writ petitions, injunctions, and property-related disputes.
- Handle complex construction-related matters such as contract breaches, land-use violations, property rights issues, and environmental clearances.
- Draft legal submissions, present arguments, and submit evidence before the High Court.
- Assist in obtaining interim reliefs, including stay orders and injunctions, to safeguard clients’ interests.
2. Legal Research & Strategy:
- Conduct thorough legal research on applicable laws, precedents, and rulings related to real estate and construction disputes.
- Develop effective legal strategies for both local and High Court matters.
- Stay updated on legal reforms, amendments, and regulatory changes in real estate and construction laws.
- Draft legal opinions, case briefs, and analytical notes on the viability of legal actions or defenses.
3. Client Relationship Management:
- Regularly communicate with clients regarding case progress, hearing schedules, and next steps.
- Advise clients on legal rights, property transactions, compliance requirements, and associated legal risks.
- Maintain strong professional relationships and ensure transparency throughout the legal process.
- Set realistic expectations regarding timelines and outcomes, particularly in complex litigation matters.
4. Administrative and Coordination Tasks:
- Coordinate case schedules across Pune courts and the High Court in Mumbai, avoiding conflicts.
- Oversee timely and accurate filing of documents in compliance with court procedures.
- Manage court appearances personally or delegate routine matters to junior advocates when required.
- Handle travel planning and coordination for Mumbai appearances and client meetings.
5. Mentorship and Supervision:
- Mentor junior advocates and legal assistants in drafting, research, and courtroom practices.
- Review and vet legal documents prepared by juniors before submission.
- Provide training on real estate law, construction litigation, and court procedures.
Required Skills and Qualifications:
1. Education and Experience:
- Qualification: LL.B. (Bachelor of Laws) from a recognized university; additional certifications in real estate or construction law preferred.
- Experience: Minimum 6–10 years of litigation experience, with a strong track record in real estate and construction matters at both local courts and the High Court level.
- Strong understanding of court procedures, litigation strategy, and drafting.
- Proficiency in Marathi, Hindi, and English (both written and spoken) is mandatory.
2. Legal and Technical Expertise:
- Strong expertise in property law, construction contracts, land laws, and municipal regulations.
- Familiarity with Maharashtra RERA, Civil, Consumer, Criminal, Arbitration, and Land Revenue matters.
- Excellent drafting, legal research, and analytical skills.
3. Communication & Negotiation Skills:
- Excellent advocacy, drafting, and presentation skills.
- Strong negotiation abilities, including dispute resolution and ADR mechanisms.
- Ability to simplify complex legal concepts for clients.
4. Organizational & Multitasking Skills:
- Ability to manage multiple cases efficiently across jurisdictions.
- Strong time management and prioritization skills.
- High attention to detail.
Preferred Skills:
- Experience in real estate development projects and construction litigation.
- Familiarity with land acquisition and municipal compliance processes.
- Basic knowledge of environmental laws related to construction and development.
