Key Responsibilities:
- Case Management:
- Assess the nature of disputes and recommend appropriate ADR mechanisms.
- Manage cases from initiation to resolution, including arbitration, mediation, and conciliation proceedings.
- Legal Representation:
- Represent clients in ADR proceedings such as arbitration hearings and mediation sessions.
- Documentation and Drafting:
- Draft arbitration agreements, mediation agreements, settlement deeds, and other legal documents.
- Prepare pleadings, submissions, and responses for ADR cases.
- Negotiation:
- Conduct negotiations between disputing parties to reach amicable settlements.
- Facilitate communication and bridge gaps to resolve conflicts effectively.
- Research and Analysis:
- Stay updated on relevant laws, case precedents, and procedural rules governing ADR.
- Analyze case laws and provide legal opinions or strategies for dispute resolution.
- Compliance and Regulations:
- Ensure adherence to procedural rules, institutional guidelines, and applicable laws in ADR processes.
- Maintain confidentiality and ethical standards in all proceedings.
- Client Interaction:
- Advise clients on ADR processes, potential outcomes, and risks involved.
- Act as a liaison between clients and other stakeholders during proceedings.
- Technology Utilization:
- Utilize ADR platforms and tools, including online arbitration and mediation platforms, to manage cases digitally.
- Leverage AI and analytics to enhance case strategy and decision-making.
Key Skills and Competencies:
- Strong understanding of ADR methods (arbitration, mediation, conciliation).
- Exceptional negotiation and conflict resolution skills.
- Expertise in drafting and reviewing legal documents.
- Analytical and problem-solving abilities with attention to detail.
- Excellent oral and written communication skills.
- Knowledge of institutional ADR rules (e.g., ICC, SIAC, LCIA).
- Familiarity with technology and online ADR platforms.
- Ethical judgment and commitment to maintaining client confidentiality.
Qualifications:
- Education:
- Bachelor’s or Master’s degree in Law (LLB/LLM).
- Specialization or certification in ADR/Arbitration is preferred.
- Experience:
- Minimum 3–5 years of experience in ADR or related legal practice.
- Hands-on experience in arbitration, mediation, or conciliation proceedings.
- Licensing:
- Licensed to practice law in the relevant jurisdiction.
