Job Summary:
The AM/DM Contracts Administration (Techno Commercial/Contract Execution) will be responsible for the comprehensive management of contracts throughout their lifecycle, with a strong emphasis on techno-commercial aspects and execution. This role involves ensuring contractual compliance, mitigating risks, managing claims, and optimizing contract performance for various projects. The ideal candidate will possess a deep understanding of contract law, project execution, and commercial implications within an engineering or construction environment.
Key Responsibilities:
Draft, review, negotiate, and administer various types of contracts, including EPC, EPCM, supply, service, and consultancy agreements, ensuring alignment with company policies and project objectives.
Manage the entire contract execution process, from award through close-out, ensuring all contractual deliverables and milestones are met by all parties.
Identify, analyze, and mitigate contractual risks, proactively developing strategies to protect the company's interests.
Prepare, negotiate, and settle claims, variations, change orders, and disputes efficiently and effectively, maintaining accurate documentation.
Monitor contractor/vendor performance against contractual terms, ensuring adherence to scope, schedule, and budget.
Liaise extensively with internal stakeholders (Legal, Project Management, Finance, Procurement, Engineering) and external parties (clients, subcontractors, vendors) to ensure seamless contract administration.
Maintain comprehensive and organized contract documentation, records, and correspondence in compliance with company standards and legal requirements.
Conduct contract audits and reviews to ensure compliance and identify areas for improvement in contract management processes.
Develop and implement strategies for effective contract close-out, including final payments, release of retention, and resolution of outstanding issues.
Preparation of Extension of Time & Cost Claim
Submission of Notices and Responses as per Contract
Change Management claim
Post-award, managed contract execution, including correspondence with contractors, monitoring compliance with project schedules,and ensuring adherence to contractual obligations.
Implemented project-specific commercial procedures, ensuring timely issuance of
contractual notices, and managed claims, counterclaims, and other contractual matters.
Adressing issues related to quality, EOTs, claims, variations, hindrances, bank guarantees, insurance policies, and penalties.
Applied international best practices, particularly FIDIC principles, in contract management, claim assessments, and dispute resolutions.
Should be Proficient in handling Extensions of Time (EOTs), variations, delay and disruption claims, delay damages, and programs, utilizing the SCL Protocol for EOTs and related claims.
Provided proactive contractual and commercial advice, ensuring risk mitigation and optimal project outcomes.
Prepared and monitored claims documentation, supporting negotiations and dispute resolution processes.
Managed the end-to-end process of contractor billing, ensuring accurate and timely
submission of RA Bills and Price Variation Bills as per project milestones and contract
requirements.
Coordinated with the Project Manager to ensure alignment between project progress
and billing milestones, minimizing discrepancies and delays in billing cycles.
Administered subcontractor billing, including verification of work progress, preparation of
running bills, and coordination with subcontractors for submission of invoices.
Ensured timely payments and processed payments to Contractors, maintaining strong financial health of the project.
Provided continuous support in resolving any billing disputes with subcontractors, ensuring prompt resolution and minimal project disruptions.
