Position Summary
West Pioneer India is seeking an experienced Legal Manager / Legal Counsel with mandatory exposure to mall and retail real estate operations. The role involves end-to-end handling of litigation and non-litigation matters related to shopping malls, leasing, tenants, vendors, and property management. The incumbent will work closely with business, leasing, and operations teams to provide practical legal solutions and ensure regulatory compliance.
Key Responsibilities
1. Litigation Management
Handle litigation matters related to mall and real estate operations including:
Tenant disputes
Consumer complaints
Civil and commercial suits
Regulatory matters
Arbitration and recovery cases
Coordinate with external advocates and law firms; monitor case progress and ensure timely filings and hearings.
Draft and review legal briefs, affidavits, replies, notices, and pleadings.
Assist in settlements, mediation, and dispute resolution strategies.
2. Non-Litigation & Contract Management
Draft, review, and negotiate:
Lease Deeds and Leave & License Agreements
MOUs, NDAs, and commercial contracts
Vendor, service, and facility management agreements
Handle tenant onboarding documentation, renewals, exits, amendments, and handover-related documentation.
Vet contracts related to mall operations, marketing activities, fit-outs, branding, and services.
3. Mall & Real Estate Legal Support
Provide legal advisory on:
Property and tenancy laws
Retail leasing frameworks
Mall-specific operational issues
Ensure compliance related to:
Signage and branding
Parking and commercial usage
Common area maintenance (CAM) issues
Support leasing and operations teams on day-to-day legal queries involving tenants and vendors.
4. Compliance & Regulatory
Ensure adherence to applicable laws including:
Property and contract laws
Local municipal regulations
RERA and other real estate compliances
Liaise with government authorities and regulatory bodies, as required.
5. Risk Management & Legal Advisory
Identify potential legal risks in mall and real estate transactions.
Recommend and implement risk mitigation strategies.
Ensure compliance with internal legal policies and SOPs.
Desired Profile
LLB (Law Graduate) from a recognized institution.
8–9 years of post-qualification experience.
Mandatory experience in the mall and/or retail real estate sector.
Strong exposure to both litigation and non-litigation matters.
Sound knowledge of real estate laws, lease documentation, and commercial contracts.
Excellent drafting, negotiation, and stakeholder management skills.
Ability to work closely with business, leasing, and operations teams.
