Job Description – Lawyer (Recovery for legal matters)
Key Responsibilities
· Legal Drafting: Draft, issue, and review legal notices (e.g., Section 138 of the NI Act), demand letters, and replies.
· Litigation & Representation: File and manage recovery suits, insolvency petitions, and civil/criminal cases.
· Tribunal & Court Appearances: Represent clients in proceedings before the Debt Recovery Tribunal (DRT), National Company Law Tribunal (NCLT), and High Courts.
· Asset Repossession: Implement legal mechanisms like the SARFAESI Act to secure, seize, and auction collateral or properties.
· Settlement Negotiation: Structure payment plans and negotiate commercial settlements to resolve disputes out-of-court.
· Regulatory Compliance: Track and abide by state and national debt collection laws, maintaining accurate, legally sound records.
· Other Cheque Bounce and all legal matters
Essential Qualifications
· Education: Bachelor’s degree in Law (LLB) and a valid practicing license.
· Experience: Typically 4 to 7+ years in dispute resolution, banking law, or civil litigation.
· Knowledge Base: Strong familiarity with the Insolvency and Bankruptcy Code (IBC), SARFAESI Act, and Negotiable Instruments Act.
· Skills: Strong negotiation tactics, excellent legal drafting, resilience, and sharp commercial awareness.
