Role Summary
The Legal Officer is responsible for providing legal support to the organization by managing contract drafting, reviewing legal documentation, handling litigation matters, ensuring compliance with applicable laws, and coordinating with external legal counsel and government authorities. The role also involves managing RERA compliance, property-related legal documentation, and safeguarding the company's legal interests.
Key Responsibilities
1. Contract Drafting & Documentation
- Draft, review, vet, and negotiate various legal agreements including Sale Agreements, Lease Agreements, Vendor Agreements, Service Agreements, NDAs, MOUs, Joint Development Agreements, and other commercial contracts.
- Ensure all agreements are legally compliant and aligned with the company's business objectives.
- Maintain a repository of legal documents and standard contract templates.
2. Legal Notices & Opinion
- Draft, review, and respond to legal notices received from customers, vendors, employees, and statutory authorities.
- Prepare legal notices on behalf of the company for contractual breaches, recovery matters, and other disputes.
- Provide legal opinions and advisory support to internal departments on business transactions and legal risks.
3. Litigation & Court Matters
- Coordinate with external advocates on civil, criminal, consumer, labour, arbitration, and property-related litigation.
- Prepare case briefs, affidavits, replies, petitions, and supporting legal documentation.
- Monitor court proceedings, maintain case status reports, and ensure timely filing of documents.
- Track litigation timelines and coordinate with concerned departments for necessary records and evidence.
4. RERA Compliance
- Ensure compliance with the Real Estate (Regulation and Development) Act (RERA).
- Coordinate registration of real estate projects under RERA.
- Prepare and file statutory disclosures, updates, and quarterly/annual compliance requirements.
- Handle customer complaints and proceedings before RERA authorities in coordination with legal counsel.
5. Property Due Diligence
- Conduct title verification and legal due diligence for land acquisition and development projects.
- Examine title deeds, ownership documents, encumbrance certificates, approvals, and statutory permissions.
- Identify legal risks associated with property transactions and recommend mitigation measures.
6. Regulatory & Statutory Compliance
- Ensure compliance with applicable laws including Contract Act, Transfer of Property Act, Registration Act, Stamp Act, Companies Act, and other relevant regulations.
- Liaise with government departments, regulatory authorities, and legal consultants for statutory approvals and legal documentation.
- Monitor changes in laws and advise management on their business impact.
7. Legal Records & Risk Management
- Maintain accurate records of agreements, litigation files, notices, and legal correspondences.
- Develop and implement legal compliance checklists and documentation processes.
- Identify legal risks and recommend preventive measures to minimize litigation exposure.
Qualifications
- LL.B. (Bachelor of Laws) – Mandatory.
- LL.M. will be an added advantage.
