A junior advocate in a revenue and land law practice acts as the backbone of the legal team. They are responsible for conducting title searches, verifying land titles, preparing legal opinions, and researching case precedents to support senior counsel in revenue courts and tribunals.
Core Responsibilities
1. Title Search & Due Diligence
- Document Verification: Investigating the chain of custody for land titles by examining property deeds, encumbrance certificates, and partition deeds.
- Revenue Records: Pulling and verifying land records like 7\12 extracts, Khata certificates, and mutation registers from local municipal or village revenue offices (Talathi/Tehsildar offices).
- Report Generation: Drafting formal Title Search Reports and Legal Scrutiny Reports outlining any encumbrances, liens, or legal defects on a property.
2. Legal Research & Case Preparation
- Precedent Research: Analyzing judicial opinions from the Supreme Court, High Courts, and Revenue Tribunals to identify relevant precedents for ongoing disputes.
- Statutory Interpretation: Researching complex state-specific revenue acts (e.g., Maharashtra Land Revenue Code, Bombay Tenancy and Agricultural Lands Act).
3. Drafting & Documentation
- Pleadings: Assisting senior advocates in drafting petitions, appeals, revisions, and writ petitions to be filed before the Sub-Divisional Officer (SDO), District Collector, Revenue Tribunals, or High Courts.
- Transactional Documents: Drafting non-litigation revenue documents such as title deeds, sale agreements, and powers of attorney.
4. Court & Administrative Coordination
- Registry Follow-ups: Managing e-filings, tracking case statuses, and handling procedural follow-ups with court or tribunal registries.
- Client Communication: Acting as the bridge between clients, senior counsel, and revenue officers, ensuring a seamless flow of case information.
