Job Summary
The Legal Advisor will provide legal guidance and support to the school management on matters related to education laws, CBSE affiliation requirements, employment issues, contracts, statutory compliance, student-related matters, and dispute resolution. The role is responsible for minimizing legal risks, ensuring regulatory compliance, and protecting the interests of the institution. CBSE schools increasingly require legal oversight for compliance, contract management, labor matters, and regulatory interactions.
Key Responsibilities1. Legal Compliance & Regulatory Affairs
- Ensure compliance with CBSE Affiliation Bye-Laws, circulars, notifications, and regulatory requirements.
- Monitor changes in education laws, government policies, and statutory regulations affecting school operations.
- Advise management on compliance with labor laws, child protection laws, trust/society regulations, and educational regulations.
- Coordinate with government departments, education boards, and statutory authorities when required.
2. Contract Management
- Draft, review, vet, and negotiate contracts, MOUs, vendor agreements, lease agreements, service contracts, and partnership documents.
- Review school policies and legal documentation to mitigate risks.
- Maintain a repository of legal agreements and compliance records.
3. Employment & HR Legal Support
- Advise on employment contracts, disciplinary proceedings, employee grievances, and termination matters.
- Ensure compliance with applicable labor laws and employment regulations.
- Support HR in handling legal issues related to staff recruitment, misconduct, and workplace disputes.
4. Student & Parent Matters
- Provide legal guidance on student disciplinary issues, complaints, grievances, and parent disputes.
- Assist in drafting responses to legal notices and complaints received from parents, authorities, or external parties.
- Advise on issues related to student safety, child rights, and safeguarding policies.
5. Litigation & Dispute Resolution
- Coordinate with external advocates and legal consultants for court cases and legal proceedings.
- Draft notices, replies, affidavits, petitions, and legal opinions.
- Monitor ongoing litigation and keep management informed about case status and legal risks.
6. Risk Management
- Identify potential legal risks and recommend preventive measures.
- Conduct legal audits and compliance reviews.
- Develop policies and procedures to safeguard the institution against legal liabilities.
7. Training & Advisory
- Conduct awareness sessions for management and staff on legal compliance and regulatory updates.
- Provide legal opinions on operational and strategic decisions affecting the school.
Qualifications
- Bachelor's Degree in Law (LL.B.) – Mandatory
- LL.M. preferred
- Enrollment with the Bar Council of India preferred
- Additional certifications in education law, labor law, or compliance will be an advantage.
